Fence & gate installation in Martin County, FL

Outside city and town limits — Palm City, Jensen Beach, Hobe Sound and the rest of unincorporated Martin County — fences are permitted by the county Building Department. After installation, the contractor (or owner-builder) signs the county’s Fence Affidavit of Completion for the permit and submits it through the county’s online portal. The affidavit certifies that the fence is:

• No more than 6 feet on the property line, and inside the owner’s boundaries
• On corner lots, built within the building setbacks
• Not within 25 feet of a navigable waterway, except fencing that runs perpendicular to the shoreline
• Not in wetlands, preserve areas or preserve-area easements, unless the county’s Growth Management Department authorizes it in writing
• Backed by letters from all utility companies if it crosses an easement
• In a Community Redevelopment Area, compliant with the CRA’s front-yard design standards

The county’s fence permit checklist (rev. 2-26) asks for the building permit application and a survey or site plan showing existing structures, the fence location, setbacks to the property lines, fence height and type, and any easements; an easement agreement is needed only when the fence is built within an easement.
